Términos y Condiciones de Panther by Inex

Estos Términos y Condiciones (“Términos”) regulan el uso de la aplicación de billetera sin custodia denominada PANTHER by INEX, ofrecida por INEX GLOBAL ST LTD, registrada en la jurisdicción de Ground Floor, The Sotheby Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia.

Al descargar, acceder o utilizar la billetera Panther, usted (“Usuario”) reconoce que ha leído, comprendido y aceptado todos los términos aquí expuestos. Si no está de acuerdo con alguno de estos términos, deberá abstenerse de utilizar la aplicación o cualquiera de sus servicios.

1. Naturaleza del Servicio

PANTHER by INEX es una billetera sin custodia que permite a los usuarios recibir, almacenar, transferir y visualizar activos digitales. Como billetera sin custodia:

  • Usted es el único responsable del control de sus claves privadas, frases de recuperación y contraseñas.
  • INEX GLOBAL ST LTD no tiene acceso, custodia ni capacidad para recuperar sus fondos o credenciales.

NO SOMOS UNA INSTITUCIÓN FINANCIERA, NI OFRECEMOS SERVICIOS DE CUSTODIA O GARANTÍA DE ACTIVOS.

2. Elegibilidad

Para usar PANTHER, usted declara y garantiza que:

  • Tiene al menos 18 años de edad o es mayor de edad en su jurisdicción.
  • Tiene plena capacidad legal para aceptar estos Términos.
  • No se encuentra en una jurisdicción sancionada o restringida según las listas internacionales (OFAC, UE, ONU, etc.).
  • No utilizará la billetera para realizar actividades ilegales, incluyendo, pero no limitándose a: lavado de activos, financiación del terrorismo, fraude o evasión fiscal.

3. Control y Responsabilidad del Usuario

Al usar Panther:

  • Usted es el único responsable de almacenar de forma segura su frase de recuperación (seed phrase), claves privadas y cualquier información de autenticación.
  • INEX GLOBAL ST LTD no puede acceder, recuperar ni restaurar su billetera si pierde su frase de recuperación.
  • Cualquier pérdida, robo o acceso no autorizado a su dispositivo o claves será de su exclusiva responsabilidad.

4. No Garantía de Reversibilidad

Todas las transacciones realizadas a través de Panther son irreversibles. Usted debe revisar cuidadosamente toda la información antes de confirmar una transacción. INEX GLOBAL ST LTD no será responsable por errores de envío, dirección incorrecta o pérdida de fondos por mal uso de la aplicación.

5. Tarifas y Comisiones

Panther puede cobrar tarifas por servicios complementarios como compras de criptoactivos, conversiones o integraciones con tarjetas. Las tarifas aplicables se mostrarán previamente y pueden variar según el proveedor de servicios externo. INEX GLOBAL ST LTD no se hace responsable por tarifas impuestas por terceros.

6. Integraciones de Terceros

La aplicación puede incluir servicios o conexiones con proveedores externos (ej. exchanges, pasarelas de pago, tarjetas Visa INEX Card, etc.). INEX GLOBAL ST LTD no controla, aprueba ni garantiza el funcionamiento de dichos terceros. Usted asume todo el riesgo al utilizar servicios externos desde Panther.

7. Riesgos Asociados

Al utilizar Panther usted acepta que:

  • El uso de criptoactivos y tecnología blockchain implica riesgos inherentes, incluyendo, pero no limitados a: alta volatilidad, fallos tecnológicos, ataques cibernéticos, regulación cambiante y pérdida de fondos.
  • Usted utiliza el servicio bajo su propio riesgo y reconoce que INEX GLOBAL ST LTD no ofrece asesoramiento financiero ni garantiza rendimientos o beneficios económicos.

8. Propiedad Intelectual

Todos los derechos sobre el nombre, logotipos, marcas, interfaces y código fuente de Panther pertenecen a INEX GLOBAL ST LTD. Usted se compromete a no copiar, reproducir, modificar, descompilar o distribuir la aplicación sin autorización escrita.

9. Uso Prohibido

Usted se compromete a no utilizar Panther para:

  • Facilitar actividades ilícitas.
  • Violar derechos de terceros.
  • Acceder sin autorización a otros sistemas.
  • Interferir con el funcionamiento de Panther o sus servidores.

INEX GLOBAL ST LTD se reserva el derecho de restringir o suspender el uso de la aplicación ante sospechas de incumplimiento.

10. Limitación de Responsabilidad

EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY, INEX GLOBAL ST LTD NO SERÁ RESPONSABLE POR:

  • Pérdidas de fondos.
  • Daños directos, indirectos, especiales, incidentales o consecuenciales.
  • Fallos de conectividad, interrupciones o errores en la aplicación.

El uso del servicio es “TAL CUAL” y “SEGÚN DISPONIBILIDAD”, sin garantías de ningún tipo.

11. Modificaciones

Nos reservamos el derecho de modificar estos Términos en cualquier momento. Le notificaremos mediante actualización en la aplicación o sitio web. El uso continuado del servicio después de los cambios implica su aceptación.

12. Ley Aplicable y Jurisdicción

Estos Términos se rigen por las leyes de Saint Lucia. Cualquier disputa será sometida a los tribunales de dicha jurisdicción, salvo disposición contraria por normativas locales obligatorias.

13. Aceptación

Al crear una cuenta, instalar o utilizar Panther, usted reconoce que ha leído, entendido y aceptado estos Términos y Condiciones.

Si no está de acuerdo con estos Términos, no debe utilizar Panther ni sus servicios asociados.

These Terms and Conditions («Terms») govern your use of the non-custodial wallet application known as PANTHER by INEX, offered by INEX GLOBAL LLC, registered under the jurisdiction of St. Ground Floor, The Sotheby Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia.

By downloading, accessing, or using the Panther wallet, you («User») acknowledge that you have read, understood, and agreed to all the terms outlined herein. If you do not agree with any of these Terms, you must refrain from using the application or any of its services.

1. Nature of the Service

PANTHER by INEX is a non-custodial wallet that enables users to receive, store, transfer, and view digital assets. As a non-custodial wallet:

  • You are solely responsible for the control of your private keys, recovery phrases, and passwords.
  • INEX GLOBAL ST LTD does not have access to, custody of, or the ability to recover your funds or credentials.

WE ARE NOT A FINANCIAL INSTITUTION, NOR DO WE OFFER CUSTODY SERVICES OR GUARANTEES ON ASSETS.

2. Eligibility

By using Panther, you represent and warrant that:

  • You are at least 18 years old or of legal age in your jurisdiction.
  • You have full legal capacity to accept these Terms.
  • You are not located in, or a resident of, any jurisdiction that is subject to sanctions or restrictions under international lists (e.g., OFAC, EU, UN, etc.).
  • You will not use the wallet for any unlawful activity, including but not limited to: money laundering, terrorism financing, fraud, or tax evasion.

3. User Control and Responsibility

When using Panther:

  • You are solely responsible for securely storing your recovery phrase (seed phrase), private keys, and any authentication information.
  • INEX GLOBAL ST LTD cannot access, recover, or restore your wallet if you lose your recovery phrase.
  • Any loss, theft, or unauthorized access to your device or keys is entirely your responsibility.

4. Irreversibility of Transactions

All transactions made through Panther are irreversible. You must carefully review all information before confirming any transaction. INEX GLOBAL ST LTD is not responsible for sending errors, incorrect addresses, or loss of funds due to user error.

5. Fees and Charges

Panther may charge fees for complementary services such as crypto purchases, conversions, or integrations (e.g., with the INEX Visa Card). Applicable fees will be displayed in advance and may vary depending on third-party providers. INEX GLOBAL ST LTD is not responsible for fees imposed by third parties.

6. Third-Party Integrations

The app may include services or connections to third-party providers (e.g., exchanges, payment gateways, card issuers, etc.). INEX GLOBAL ST LTD does not control, endorse, or guarantee the operation of such third parties. You assume full risk when using third-party services through Panther.

7. Associated Risks

By using Panther, you acknowledge that:

  • The use of cryptocurrencies and blockchain technology involves inherent risks, including but not limited to: high volatility, technological failures, cyber-attacks, changing regulations, and potential loss of funds.
  • You use the service at your own risk and acknowledge that INEX GLOBAL ST LTD does not provide financial advice or guarantee returns or profits.

8. Intellectual Property

All rights to the name, logos, trademarks, user interface, and source code of Panther belong to INEX GLOBAL ST LTD. You agree not to copy, reproduce, modify, decompile, or distribute the application without prior written authorization.

9. Prohibited Use

You agree not to use Panther for:

  • Engaging in or facilitating illegal activities.
  • Violating the rights of third parties.
  • Gaining unauthorized access to systems.
  • Interfering with the operation of Panther or its servers.

INEX GLOBAL ST LTD reserves the right to restrict or suspend your access to the application if a breach of these Terms is suspected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INEX GLOBAL ST LTD SHALL NOT BE LIABLE FOR:

  • Any loss of funds.
  • Direct, indirect, special, incidental, or consequential damages.
  • Connectivity failures, interruptions, or errors within the application.

The service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind.

11. Modifications

We reserve the right to modify these Terms at any time. We will notify you through updates on the application or website. Continued use of the service after changes constitutes your acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Saint Lucia. Any dispute shall be submitted to the courts of this jurisdiction, unless otherwise mandated by local law.

13. Acceptance

By creating an account, installing, or using Panther, you acknowledge that you have read, understood, and accepted these Terms and Conditions.

If you do not agree with these Terms, you must not use Panther or any of its associated services.
